Federal prosecutors allege James misrepresented her intentions for the $137,000 home when securing a $109,600 mortgage loan in 2020. The loan, originated by OVM Financial and backed by Fannie Mae, included a “Second Home Rider” agreement that explicitly required James to use the property as a secondary residence. “Despite these representations,” prosecutors wrote, the property “was not occupied or used by James as a secondary residence and was instead used as a rental investment property.” By securing the mortgage under false pretenses, James allegedly obtained a more favorable interest rate than would have been available for an investment property.<\/p>\n
The indictment states that James’s “ill-gotten gains” from the lower mortgage rate amounted to “approximately $18,933 over the life of the loan.” Prosecutors further note that James represented the property as “owner occupied” on her homeowners’ insurance application, while simultaneously treating it as “rental real estate” on federal tax forms where she reported “thousand(s) of dollars in rents received” and claimed rental-related expense deductions.<\/p>\n
James now faces charges of bank fraud and making false statements to a financial institution. If convicted on both counts, she could face up to 60 years in prison and fines reaching $2 million. Her first court appearance is scheduled for October 24 in federal court in Virginia.<\/p>\n
The legal defense costs for fighting these charges could be substantial, with experts estimating between $5 million and $10 million in total expenses. While New York has a taxpayer-funded $10 million legal defense fund available to state officials, James’s office has stated she will not use these public funds.
